Caldwell does not impose special industrial noise limits. Caldwell's noise ordinance is written to accommodate, not single out, industrial activity. As a result, there is no separate decibel cap or special set of hours for factories, warehouses, or industrial sites operating in their proper zones; their routine operations are treated as permitted. The general Public Noise Disturbance rule (Section 07-13-03) still applies where the activity is not 'regular business' in an appropriate zone—for example, an industrial-type noise source intruding on a residential area between 11:00 p.m. and 7:00 a.m. and plainly audible 150 feet away. Industrial land uses are also shaped by Caldwell's zoning code, which determines where such uses may locate. For nuisance-type complaints that fall outside the zoning exemption, the City's nuisance abatement procedures (Section 07-11-05) provide the enforcement mechanism, and persistent unreasonable noise could be evaluated under the disorderly conduct standard (Section 08-01-27).
Routine industrial operations in correctly zoned areas are exempt under Section 07-13-05, so they generally cannot be cited as public noise. Industrial noise that falls outside that exemption and is plainly audible 150 feet away during quiet hours (11 p.m.–7 a.m.) can be cited under Section 07-13-03 and abated under Section 07-11-05, where a continuing noticed nuisance is a misdemeanor and each day may be a separate offense.
