Queen Creek has no separate industrial noise chapter; commercial and industrial sources fall under the general noise ordinance in Article 9-6. Section 9-6-5 bars unreasonable noise and expressly weighs whether the noise comes from a commercial activity and the area's zoning. Heating and cooling equipment is exempt when it meets the manufacturer's specifications. Nighttime noise is capped under Section 9-6-4.
Queen Creek does not maintain a stand-alone industrial-noise standard with zone-by-zone decibel limits; commercial and industrial noise is handled through the same Article 9-6 provisions that apply townwide. Section 9-6-5 (Unnecessary Noise) makes unreasonable noise unlawful and, among its factors, directs officials to consider 'whether the noise is produced by a commercial or noncommercial activity' and 'the nature and zoning of the area within which the noise emanates,' so a business or industrial operation is judged in context. Section 9-6-4 (Nighttime Noise) bars loud, unreasonable, or excessive noise from any property between 10:00 p.m. and 6:00 a.m. unless an exclusion or permit applies, which constrains overnight commercial operations. Section 9-6-8 (Exemptions) carves out certain mechanical sources: heating and cooling equipment is exempt when functioning in accordance with the manufacturer's specifications and in proper operating condition, and railroad train noise from normal operation is exempt. Utility company and governmental vehicles operating on official business are also exempt. A violation of these noise provisions is a Civil Offense, and Section 9-6-12 (Nuisance) provides that repeated violations are declared a nuisance under Chapter 10 of the Town Code when they threaten public health, safety, or welfare. Code Compliance handles complaints at (480) 358-3306.
An industrial or commercial source producing unreasonable noise that disturbs the neighborhood is a Civil Offense under Section 9-6-5, judged in part by the commercial nature of the activity and the area's zoning. Nighttime operations causing loud noise violate Section 9-6-4. Repeated violations can be declared a nuisance under Section 9-6-12 and Chapter 10. Repeat Violators face a class 1 misdemeanor and a civil penalty of at least $3,000 per violation under Section 9-6-10.
