Outside that 6:00 a.m.β10:00 p.m. window, the exemption no longer applies, and the equipment is subject to the Town's Nighttime Noise rule (Section 9-6-4), which bars loud, unreasonable, or excessive noise between 10:00 p.m. and 6:00 a.m. The Town's Code Compliance page reinforces this, stating the noise restriction from 10:00 p.m. to 6:00 a.m. specifically includes landscape machine noise. Equipment that is broken, unmuffled, or running outside the daytime window can therefore be cited under the general noise provisions even though daytime use is otherwise permitted. Running landscape equipment outside the 6:00 a.m.β10:00 p.m. exemption window, or with missing or defective mufflers or noise-reducing equipment, removes the Section 9-6-8 exemption and exposes the operator to a noise Civil Offense (for example under Section 9-6-4 for nighttime use). Repeat Violators face escalation under Section 9-6-10, including a class 1 misdemeanor and a civil penalty of at least $3,000 per violation.
