Queen Creek limits noisy construction by season under Section 9-3-3 of the Town Code. From May 1 to October 15, weekday work is barred before 5:00 a.m. and after 7:00 p.m.; the rest of the year it is barred before 6:00 a.m. and after 7:00 p.m. Saturdays are more restricted and Sundays are off-limits without a construction permit.
Town Code Section 9-3-3 (Regulations During Nighttime and Holiday Construction), adopted by Ordinance 764-21 and later amended by Ordinances 784-22 and 867-25, prohibits construction activities that generate loud, unreasonable, or excessive noise during set time periods unless a Nighttime and Holiday Construction Permit (NHCP) is obtained under Section 7-1-4-10. From May 1 to October 15, construction is prohibited prior to 5:00 a.m. and after 7:00 p.m. Monday through Friday, prior to 7:00 a.m. and after 7:00 p.m. on Saturdays, and at all times on Sundays. For the remainder of the year, construction is prohibited prior to 6:00 a.m. and after 7:00 p.m. Monday through Friday, prior to 7:00 a.m. and after 5:00 p.m. on Saturdays, and at all times on Sundays and Legal Holidays as defined by the Town. Concrete pouring is permitted one hour before general construction may begin. Noise from work performed by a resident of a residential building may continue until 10:00 p.m. but may not begin earlier than the section's start times. Emergency repairs are allowed whenever necessary. The Development Services Director may issue a written stop order for violations. Conducting noisy construction outside the allowed hours, or without a required NHCP, is a Civil Offense under Section 9-3-3, and Section 9-6-10 (Repeat Violators) applies. Officials may issue a written stop order requiring work to halt until a permit is obtained; failure to obey a stop order is a separate violation. Repeat Violators face a class 1 misdemeanor and a civil penalty of at least $3,000 per violation.
