San Clemente limits industrial and manufacturing property noise to 70 dB(A) at all hours under SCMC §8.48.050. Fixed equipment such as HVAC, pumps and pool machinery must be muffled to meet these standards.
Under §8.48.050, industrial or manufacturing receiver property is limited to 70 dB(A) day and night (the nighttime standard applies if buildings are occupied during those hours). Commercial property limits are 65 dB(A) day / 60 dB(A) night. "Fixed noise source" under §8.48.020 covers industrial and commercial machinery, pumps, fans, compressors, generators, air conditioners and refrigeration equipment. Section §8.48.070(L) requires HVAC and pool/spa/fountain equipment to be enclosed or muffled so as not to create a disturbance under §8.48.050, and the City may require written proof of compliance. Pre-existing commercial/industrial operations received a six-month compliance window with possible hardship exceptions (§8.48.090(O)). Operators exceeding limits may apply for an exception through the Community Development Director and Planning Commission (§8.48.100).
Exceeding the 70 dB(A) industrial or 65/60 dB(A) commercial limits is a prima facie violation. Enforcement under SCMC §1.16.010: misdemeanor up to $1,000/six months or infraction $100/$200/$500, plus fines. An exception may be sought under §8.48.100.
