Outdoor concerts, festivals and public events that will exceed noise limits need a permit (a limited waiver) from the Escambia County Board of County Commissioners. Without stated times, a permit cannot allow excessive noise before 12:00 noon, past 10:30 p.m., or for more than four hours.
Escambia County Code Sec. 42-66(g) exempts special outdoor events from the noise limits only when a permit authorizing a limited waiver has been obtained from the Board of County Commissioners. The applicant files with the county administrator, stating the site, dates, times, the activity that will exceed limits, and steps to minimize disturbance to neighbors. The Board sets the dates and times the noise may exceed limits. If the permit does not specify times, excessive noise may not begin before 12:00 noon, extend beyond 10:30 p.m., or continue more than four hours between noon and 10:30 p.m. On the barrier islands, event sound is also measured against the decibel caps in Sec. 42-67.
Holding an unpermitted event that exceeds limits is a misdemeanor: fine up to $500 or 60 days jail (Sec. 42-69).
