Escambia County has no separate industrial decibel table for most areas; industrial and commercial noise is judged under the general unreasonableness standard, which expressly weighs the zoning of the area. Loud loading and unloading of vehicles or vessels at a business or residence is a per se violation.
For most of unincorporated Escambia County, industrial and commercial noise is evaluated under Sec. 42-64, which lists factors including the volume and intensity of the sound, background noise, proximity to residential sleeping facilities, and the nature and zoning of the area. Sec. 42-65(i) specifically makes it a per se violation to create unreasonably loud noise while loading or unloading any vehicle or vessel at a place of business or residence. On Santa Rosa Island and Perdido Key, fixed decibel caps under Sec. 42-67 apply to any source of sound, including commercial operations. Ordinary sounds incidental to lawfully operated businesses conducted to usual standards are exempt under Sec. 42-65(a).
Misdemeanor under Sec. 42-69: fine up to $500 or up to 60 days jail; each day of continuing violation is a separate offense.
