Playing a radio, stereo, boombox or instrument that is plainly audible 100 feet away in a commercial, industrial or public space is a per se violation in unincorporated Escambia County. Sound that unreasonably disturbs neighbors in residential areas is also prohibited under Sec. 42-65(e).
Escambia County Code Sec. 42-65(e) bars operating a radio, television, boombox, stereo, musical instrument or similar device so it is plainly audible to others (beyond voluntary listeners) and unreasonably disturbs neighbors in residential or noise-sensitive areas, or is plainly audible 100 feet away in a commercial, industrial or public space. Amplifiers and PA systems are further restricted at night under Sec. 42-65(f) (10:00 p.m.-7:00 a.m. weekdays; 10:00 p.m.-10:00 a.m. weekends/holidays). In Pensacola, electronic amplification audible beyond 50 feet is prohibited 11:00 p.m.-7:00 a.m. in listed residential zones (Sec. 8-1-13(b)(10)). On Santa Rosa Island and Perdido Key, fixed decibel caps replace this standard (Sec. 42-67).
County: misdemeanor, fine up to $500 or 60 days jail (Sec. 42-69). Pensacola: misdemeanor under Sec. 1-1-8. Each day is a separate offense.
