Full Breakdown
Section 147-9 of the Township Code sets time-of-day limits instead of a single curfew. Under § 147-9(A), a residential property owner or tenant cannot operate power tools, home maintenance tools, or landscaping and yard maintenance equipment between 8:00 p.m. and 8:00 a.m. unless the activity can meet the applicable limits set forth in Tables I, II or III, and all motorized equipment must be operated with a muffler and/or sound reduction device. Emergency work is excluded. At all other times the Table limits do not apply to those activities.
Under § 147-9(B), nonresidential operators such as commercial operators and public employees cannot run power tools or landscaping and yard maintenance equipment on a residential, commercial, industrial or public property, including a golf course, park or athletic field, between 6:00 p.m. and 8:00 a.m. on weekdays, or between 6:00 p.m. and 9:00 a.m. on weekends or federal holidays, unless the activity meets the Table limits.
Section 147-9(C) applies the same structure to construction and demolition: none, excluding emergency work, between 6:00 p.m. and 7:00 a.m. on weekdays, or between 6:00 p.m. and 9:00 a.m. on weekends and federal holidays, unless the Table limits are met. Section 147-2 defines a weekday as beginning Monday at 7:00 a.m. and ending the following Friday at 6:00 p.m., and weekends as beginning Friday at 6:00 p.m. and ending the following Monday at 7:00 a.m. Subsection (E) requires burglar alarms of a building or motor vehicle to stop within five (5) minutes for continuous airborne sound and fifteen (15) minutes for intermittent sound.
Outside those equipment rules, the nighttime standard in § 147-7, Table I, is 50 dB outdoors at a receiving residential property from 10 p.m. to 7 a.m., against 65 dB from 7 a.m. to 10 p.m. Sound production devices also tighten after 10:00 p.m., from a plainly audible distance of 50 feet to 25 feet under § 147-9(F) and § 147-10.
Violations & Fines
Under § 147-6.1, any person who violates Chapter 147 is liable on conviction for a fine not to exceed $2,000 or imprisonment in the County Jail for a term not exceeding 90 days, or both, unless otherwise specified. Section 147-6.2(D) sends operating construction equipment during prohibited hours to that penalty, while § 147-6.2(F) and (H) list $60 for a first offense in 12 months for refuse compactor and trash collection hours. Under § 147-11, a minor violation draws a Notice of Violation and a non-minor one a Notice of Penalty Assessment.
