Fayette County, GA Noise Ordinances: Quiet Hours (2026)

Section 16-37 defines 'night or nighttime' for the noise article as the hours between and including 9:01 p.m. and 6:59 a.m. on weekdays, and between 10:01 p.m. and 8:59 a.m. on weekends. Section 16-39(2) then declares that sounds from a specific list of activities, tools such as saws and blowers, internal combustion equipment, construction, idling trucks over 10,000 pounds GVWR, bells and chimes, and loud musical or amplified sound, are public disturbance noises whenever they occur at night and are received on property in a residential district. This nighttime list operates alongside, and is more restrictive than, the general decibel-based limits in Section 16-38 and the anytime prohibitions in Section 16-39(1). Several nighttime sounds remain exempt regardless of the hour, including emergency equipment, safety and warning devices, and construction noise received on commercial or industrial property, under Section 16-40. The administrator's staff and the marshal's office enforce the quiet-hours provisions under Section 16-42, with penalties set by Section 1-7.
