Oneida, NY Noise Ordinances: Vehicle Noise (2026)

City of Oneida Code Chapter 98, Noise, opens with a general ban on "unreasonable noise" and then lists specific acts that automatically violate the chapter. Two apply directly to vehicles. Section 98-3(D) bars intentionally operating a vehicle so as to cause unreasonable noise by spinning its tires, the classic peel-out or burnout. Section 98-3(F) separately requires every motor vehicle operated in the city to carry an operating muffler or other sound-suppressing equipment that prevents the vehicle from causing unnecessary noise; driving with a straight-piped, cut-out or otherwise defective exhaust falls squarely under this subsection.

The chapter's definitions section reinforces both provisions with a presumption of unreasonableness for any noise, from a vehicle or otherwise, that is "plainly audible at a distance of 50 feet" from where it originates, giving police an objective test they can apply from the sidewalk without a decibel meter. Section 98-6 sets the penalty structure that governs both the tire and muffler violations: a first violation of any Chapter 98 provision is punishable by a fine not exceeding $250, and the City may separately seek an injunction against a continuing violation.

A second violation of the chapter by the same person within one year of a prior conviction escalates to a misdemeanor, carrying a fine of up to $1,000, imprisonment of up to one year, or both. There is no separate fix-it or warning period built into the vehicle-noise provisions themselves, unlike the apartment-noise subsection of the same chapter, so an officer can issue a citation on the first observed violation.
