Per CMC Chapter 16.04 (which adopts the 2025 California Fire Code) and CFC Section 308.1.4, open-flame cooking devices β including propane and charcoal grills β generally may not be operated on combustible balconies, decks, or within 10 feet of combustible construction in multi-family occupancies (R-2, e.g. apartments, condos). Exceptions apply where the building is protected throughout by an automatic sprinkler system, the balcony or deck is non-combustible (e.g., concrete), or for one- and two-family dwellings (single-family homes and duplexes), which are exempt from the 10-foot rule. LPG (propane) cylinders are limited to a single cylinder no greater than 20 pounds water capacity in residential settings per CFC 6104, and cylinders must not be stored indoors. The Ventura County Fire Department, which contracts with Camarillo for fire protection, enforces these rules during inspections and complaint response. Bordering electric grills are not subject to the open-flame prohibitions but still must comply with manufacturer clearance from combustibles.
Operating an open-flame grill on an apartment or condo balcony in violation of CFC 308.1.4 is enforceable as a fire code violation by Ventura County Fire Department, with administrative citations starting at $100 and escalating. Property managers can also be cited and face condition-related insurance issues. Repeat or hazardous violations can be charged as misdemeanors under CFC 109 (up to $1,000 fine, six months in jail).
