Backyard smokers at single-family homes are generally allowed. At multi-family buildings, the North Carolina Fire Prevention Code treats smokers as open-flame cooking devices, which cannot be operated on combustible balconies or within 10 feet of the building unless it is sprinklered.
The Cumberland County Fire Marshal enforces the North Carolina Fire Prevention Code, which regulates charcoal, wood, and pellet smokers as open-flame or solid-fuel cooking devices. At detached one- and two-family homes, using a smoker in the yard is permitted with reasonable clearance from combustibles. At apartments and condos, smokers may not be operated on combustible balconies or within 10 feet of combustible construction, with an exception only for fully sprinklered buildings. Smokers are cooking appliances, not open burning, so they do not require a burn permit, but they must never be used to burn rubbish or yard waste.
Operating a smoker against the balcony or 10-foot clearance rule is subject to fire-code enforcement by the Fire Prevention Office.
