Full Breakdown
Section 228-224C of the East Brunswick Township Code prohibits outdoor parking in all residential zones for three classes of vehicle. The first is all construction equipment, except equipment stored on a farm for a recognized agricultural use. The second is any truck, trailer, bus or other commercial vehicle with a length greater than 20 feet, a width greater than seven (7) feet (rearview mirrors excluded) or a height greater than eight (8) feet (radio antenna excluded), plus every cab or tractor capable of pulling a trailer. The third is auto cabs and limousines. The lead-in to § 228-224 names the zones covered: R-1, R-2, R-3, R-4 and R-5, the Historic District residential zones and the Rural Preservation zones.
The section carves out exceptions for privately used campers and motorhomes, for vehicles making deliveries or rendering necessary services requested by an adjacent resident, and for vehicles used to maintain or repair public utilities or for other construction within the public right-of-way. Trailers intended or used for dwelling space, offices, storage or any other residential, commercial or industrial purpose are otherwise prohibited, with room for trailers used for transportation, as construction offices or for storing materials and supplies on a job site during construction. Even a vehicle inside the size limits is capped: in no event can more than one commercial vehicle be parked outdoors.
Section 228-224D adds that no commercially owned or operated limousine or auto cab can be garaged or parked overnight in a residential zone. Section 228-9B ties a private garage in the R-1 district to the same dimensions: not more than three private cars, or two private cars and one commercial vehicle no greater than 20 feet long, 7 feet wide or 8 feet high. Section 228-10C lists parking of trucks, commercial vehicles and trailers as restricted by § 228-224C among the prohibited uses in R-1. Section 228-222F separately bars parking any vehicle in the front yard of a residential lot except on an improved driveway or a surfaced parking area.
Violations & Fines
A vehicle that exceeds any one of the 20 foot length, seven foot width or eight foot height limits, or a second commercial vehicle parked outdoors on the same residential lot, violates Chapter 228. The Zoning Officer inspects and issues a summons under § 228-265. Under § 1-15 a conviction carries a fine not to exceed $2,000 and up to 90 days in the county jail or community service, and each day is a separate offense.
