Hamilton, NJ Parking Rules: Driveway Rules (2026)

Section 268-11D of Hamilton's housing standards chapter states that the front, side, and back yards of any lot containing a building shall not contain motor vehicles, except in a driveway or parking area as defined in § 550-7, and that such driveways or parking areas are to be designed and constructed pursuant to § 550-119 and maintained in a clean, orderly and dustfree condition. The cross-referenced Land Use chapter sections supply the definitions and construction standards, including the dustfree-surface requirement, for what counts as a lawful driveway or parking area; a bare patch of lawn or an unimproved gravel strip used for parking does not satisfy the ordinance if it was not built to that standard.

The rule was last amended by Ordinance No. 16-017 in 2016. It sits alongside the rest of § 268-11's outside-maintenance requirements: Subsection C bars yards from accumulating junk, unused vehicles, boats, and auto parts and caps grass and weed height at 10 inches, and Subsection E requires any yard fence to be kept in good repair, without holes or broken supports. Enforcement runs through the same inspection channel as the rest of Chapter 268: the Director of Community and Economic Development or the Chief Housing Inspector cites a violation, issues a notice under § 268-6 giving the owner up to 30 days to correct it, and can summon the owner to Municipal Court if the vehicle is not moved to a conforming surface.
