Summary

Killeen bans parking any vehicle on bare dirt or grass: driveways and parking areas must be concrete, asphalt, or another impervious surface over a compacted base. Code enforcement gives residential property owners 10 days, and commercial owners 60 days, to fix a violation after written notice, and a second violation within 12 months can bring a citation with no further warning.

(a)Except as provided in this section, it shall be unlawful to park any vehicle on anything other than an all-weather surface. An all-weather surface shall consist of Portland cement concrete or an impervious bituminous surface over a compacted base or other surface approved by the building official. The parking surface for property zoned or used for commercial and multifamily use must be capable of retaining paint or striping material. ... (c)Any person who owns or controls any lot, parcel of land, or premise within the city limits having on it a vehicle in violation of this section shall be required to remove such vehicle within ten (10) days from the date of the written notice from the code enforcement director if the property is used as residential or within sixty (60) days from the date of written notification from the code enforcement director if the property is used as commercial.

Full Breakdown

Section 28-135(a) requires that any vehicle be parked on an 'all-weather surface,' defined as Portland cement concrete or an impervious bituminous surface over a compacted base, or another surface the building official approves; commercial and multifamily lots must also be able to hold paint striping. Subsection (b) carves out exceptions: residential property with no driveway, residential property where the adjacent street bans on-street parking, vehicles parked temporarily for parades or sanctioned events, vehicles screened from public view under the landscaping or screening rules in Sections 31-20, 31-280, or 8-512, a boat, trailer, or travel trailer resting on concrete blocks, pavers, or brick at least 3 inches thick under the wheels, and commercial parking areas that predate September 24, 2002 and have not expanded since, an exception that ends once the property sells.

Subsection (c) gives code enforcement its teeth: an owner in violation gets 10 days' written notice to fix a residential lot, or 60 days for a commercial lot, before a citation issues. If a different vehicle turns up on the same non-compliant surface within 12 months and the city hasn't been told in writing that ownership changed, code enforcement can cite the owner again with no additional notice. Section 28-136 exempts agricultural (A and A-R1) zoned property entirely, and for three years after a rezoning to a less restrictive district, and lets an owner claiming economic hardship request a variance from the city manager, who must decide within 10 calendar days.

Violations & Fines

Parking on bare dirt, grass, or gravel instead of an approved all-weather surface violates Section 28-135(a). The code enforcement director must give written notice, 10 days for residential property and 60 days for commercial property, before citing a first violation. A second violation on the same property within 12 months, without written notice of an ownership change, can be cited immediately without further warning.

Frequently Asked Questions

Can I park on my grass or gravel yard in Killeen?
No, unless an exception applies. Section 28-135 requires vehicles to sit on an all-weather surface, meaning concrete, asphalt, or another impervious material over a compacted base. Residential lots with no driveway, or where street parking is already banned, are exempt, and boats or trailers can sit on thick concrete blocks or pavers instead.
How long do I have to fix an illegal parking surface after a warning in Killeen?
Ten days for residential property and 60 days for commercial property, both measured from the code enforcement director's written notice under Section 28-135(c). If another vehicle shows up on the same non-compliant surface within 12 months and you haven't reported a change in ownership, the city can cite you again with no further notice.
Is there a hardship exception to Killeen's paved-parking rule?
Yes. Section 28-136(b) lets a property owner who says compliance would cause an economic hardship apply to the city manager for a variance, and the city manager must issue a written decision within 10 calendar days setting out the specific terms of any variance granted.
