Port Orange, FL Parking Rules: Driveway Rules (2026)

Port Orange City Code Section 70-36(a)(1)k sits inside the broader list of places where stopping, standing or parking a motor vehicle or trailer is prohibited. It bars parking on any other portion of the front yard of a residential lot except on approved driveways, and then defines exactly what counts as an approved driveway for this purpose. A driveway must be built of concrete or paved materials; or nonpaved materials, excluding grass and dirt, provided that loose materials such as gravel, bark or cypress mulch are effectively contained within a border of concrete, railroad ties, or other rigid materials; or concrete paver strips, paver blocks, or other semi-pervious materials.

The practical effect is that a homeowner cannot simply drive onto the lawn or a patch of bare dirt to park, and cannot rely on loose gravel or mulch spread without a rigid contained border. This sits alongside the Land Development Code's own off-street parking design standards in Chapter 12, Section 6, which govern how new parking areas and driveways must be designed and paved, but the front-yard surface rule that determines whether a parked car itself is legal is this City Code provision, enforced through the same traffic citation process as the rest of Section 70-36. A violation is cited the same way as any other prohibited-parking spot under this section, through a municipal parking ticket issued under Section 70-33.
