Full Breakdown
Westchester County attaches its EV charging requirement to contracts. § 638.11 applies when a parking garage or open parking lot is constructed or reconstructed under a contract where the County is the builder or where the County provides discretionary funding. A private commercial lot with no County construction or funding contract behind it is outside the section.
The requirement turns on one capacity line: 250 vehicles. A new garage or open lot with a parking space capacity for 250 vehicles or fewer must be equipped with two separate allocations. Ten percent of the total number of parking spaces must be "solely" for level one charging stations. A further ten percent must be "solely" for level two charging stations "that also have the capacity for level three charging stations." The word "solely" matters in § 638.11. The two groups of spaces do not overlap, and the level two group has to be built so it can also handle level three charging. Both percentages are measured against the total number of spaces in the facility, not against a subset of them.
Above the 250-vehicle line, Westchester stops using percentages. Those larger facilities need 50 EV-ready spaces in total, split evenly between the same two tiers.
Reconstruction is covered as well as new construction. Under the Westchester rule, reconstruction means any repair or improvement costing 50% or more of the lot's market value before the work began. A rebuild of that size under a County contract carries the same charging requirement as a new facility, while smaller repairs fall below the 50% trigger.
The Commissioner of Public Works and Transportation enforces Chapter 638 and may set usage fees for the required stations.
Violations & Fines
Contracts omitting the required EV charging provisions violate Chapter 638; the Commissioner of Public Works and Transportation enforces compliance and may set usage fees for the required stations.
