Overnight parking is permitted on most Virginia Beach residential streets without a permit, subject to the 72-hour maximum and general no-parking restrictions. The Oceanfront Resort Area has different rules: metered lots close between 2 AM and 6 AM, and some residential streets within the Resort District require a decal under the Residential Permit Parking program. Sleeping in a vehicle on a public street or in a beach parking lot is prohibited. Commercial trucks over 12,000 pounds GVW may not park overnight in residential zones.
Virginia Beach does not impose a blanket overnight street-parking ban. On unposted residential streets citywide, a passenger vehicle may park overnight subject only to the 72-hour consecutive-parking cap and standard restrictions (hydrant, crosswalk, driveway, bike-lane). Municipal public parking lots (Oceanfront 9th Street Garage, 25th Street Garage, 31st Street Garage, 4th Street Surface Lot, Sandbridge Little Island lot) have posted operating hours; most surface lots close at 2 AM and reopen at 6 AM, while garages remain open but transition to daily flat-rate billing. Overnight camping or sleeping in a vehicle is prohibited under City Code Section 21-395 on any public right-of-way, beach parking area, or park. RVs with self-contained sleeping areas may not be used as overnight dwellings on public streets or in commercial lots without a special event permit. Residential Permit Parking zones (small pockets near the oceanfront, Old Beach, Shadowlawn) restrict overnight parking to sticker-bearing residents and one visitor placard from roughly May through September. HOAs (especially condominium communities along Atlantic Avenue and Shore Drive) often have private rules that are stricter than city code, including requirements to register vehicles with the property manager. Visitors and guests should pay attention to posted no-parking signs from 2 AM - 6 AM in some beach neighborhoods, which indicate street-sweeping or permit-only periods. First violations typically carry $25 fines; tow occurs after warning or in hazardous positioning.
Specific penalty amounts for this ordinance are not published in a publicly accessible fine schedule. Contact Virginia Beach code enforcement directly for current fines, enforcement procedures, and hearing options.
