Summary
In Washington, D.C. the Ward 1 Enhanced Residential Parking Program lets any Ward 1 Advisory Neighborhood Commission vote to enroll its blocks, requiring at least half of legal residential spaces on an enrolled block to be Zone 1 permit-only. Enrolled residents get a visitor pass program and a Zone 1 sticker, and blocks under active streetscape construction or within one block of the ward boundary are excluded.
(a) There is established a Ward 1 Enhanced Residential Parking Program ("Program"). Any Ward 1 Advisory Neighborhood Commission ("ANC") may, by resolution of that ANC, vote to include blocks within the ANC in the Program. The Program will consist of the following requirements: (1) Any block that participates in the residential permit parking in Ward 1 shall have at least 50% of the legal residential parking spaces on that block designated as Zone 1 Permitted Parking Only; (2) A visitor parking pass program shall be available to residents similar to the program in Mount Pleasant required by § 50-2537; and (3) Any resident owning a vehicle registered at an address on a Ward 1 residential block may be granted a Zone 1 residential parking sticker... (b) Blocks within a streetscape construction project impact zone, as designated by the Mayor, shall be excluded from the Program until the Mayor declares that all major construction associated with the streetscape has been completed. (c) The Program shall not apply within one block of a ward boundary.
Full Breakdown
C. Code § 50-2551 establishes the Ward 1 Enhanced Residential Parking Program and gives any Ward 1 Advisory Neighborhood Commission (ANC) the power to vote, by resolution, to include blocks within its boundaries in the Program. Once a block participates, subsection (a)(1) requires that at least 50% of the legal residential parking spaces on that block be designated Zone 1 Permitted Parking Only, a higher set-aside than the District's ordinary residential permit parking rules provide elsewhere in the city. C. C. Code § 50-2552. The statute carves out two exclusions that keep the Program from applying everywhere at once: subsection (b) excludes blocks inside a streetscape construction project impact zone, as designated by the Mayor, until the Mayor declares the major construction associated with that streetscape complete, and subsection (c) bars the Program from applying within one block of a ward boundary, instead requiring those boundary blocks to accept residential permits valid in either adjacent ward if the block was already a residential permit parking street before the Program began.
C. Code § 50-2552 required the Mayor to issue implementing rules within 90 days of the October 26, 2010 enactment date, submitted to the Council for a 30-day review period, and those rules had to address boundary-street eligibility, the definition of a streetscape construction impact zone, and the process and hours for the visitor pass.
Violations & Fines
The statute itself does not set a fine schedule; enforcement of Zone 1 Permitted Parking Only designations on enrolled Ward 1 blocks follows the District's standard residential permit parking enforcement, meaning a vehicle parked in a Zone 1 space without a valid Zone 1 sticker or visitor pass is subject to a parking ticket and possible towing under the District's general parking enforcement authority in Chapter 23 of Title 50. Boundary-block vehicles displaying a valid permit from either adjacent ward remain lawfully parked under § 50-2551(c) even where the Program applies to the rest of the block.
