Rockford regulates nonconsensual towing in two separate places, and which one applies turns on who ordered the tow. When the police department has a vehicle removed from a public way, the authority is Sec. 16-277, which lists nine triggers including a vehicle that illegally occupies a parking meter space, a vehicle parked in violation of sections 16-136, 16-139, 16-142 and 16-149.1, and a driver arrested for an offense requiring the officer to take the person before a magistrate without unnecessary delay. Under Sec. 16-42 the owner then pays towing, storage and redemption fees set by contract, all fines assessed against the vehicle, and on top of those an administrative processing fee set by the city. The wrecker that answers a police call comes off the rotating list the police department maintains annually before November 1 and updates each December 1, and Sec. 29-173 lets the owner or operator of a disabled vehicle name any wrecker firm of their choosing instead of taking the next name on the list. Maximum charges for a police-requested tow are set in the annual fee schedule under Sec. 29-176 rather than printed in the code.
When a private property owner orders the tow, Sec. 29-202 sets the ceiling directly and leaves nothing to a contract. A light duty vehicle may be charged no more than $216.00 to tow, a medium duty vehicle $520.00 and a heavy duty vehicle $700.00. Storage runs $40.00 a day for light duty and $140.00 a day for medium and heavy duty, but only after the first 24 hours, and no storage charge at all may be imposed for a release inside that first day between 7:00 a.m. and 9:00 p.m. Monday through Friday or between 7:00 a.m. and 6:00 p.m. Saturday. An overnight release inside the first 24 hours carries an additional charge capped at $30.00. Anything beyond those figures is unlawful, the charges must be payable by any major credit card as well as in cash, and the operator must hand over a written receipt listing every fee along with the date and time of the tow, the date and time of release, the location of the tow, the reason for it and the name of the tow truck operator.
The signage the property owner has to post is spelled out to the inch. A notice must sit at each driveway access or curb cut within five feet of the public right-of-way line, or one sign for every 100 feet of lot frontage where there are no curbs, with the bottom of the sign structure at least four feet above ground level and the sign continuously maintained for at least 24 hours before any vehicle is towed. The lettering must be at least two inches high, light reflective, on a contrasting background, and the sign has to carry the name and current telephone number of the towing service plus the amount of the towing and storage charges. Property appurtenant to and obviously part of a single-family residence is exempt, as is a tow where notice was given personally to the person in control of the vehicle.
Two duties protect the driver after the hook is attached. If the owner reaches the scene before the vehicle is actually removed and can drive it away, the tow truck must disconnect and let them go for a service fee of no more than $75.00, with a receipt. And the towing service has 30 minutes from completing the removal to notify the law enforcement agency with jurisdiction of the make, model, color and plate number, recording the name of the person it reported to, with a second notice to the police department if the vehicle is still unclaimed seven days later. The vehicle must be stored at a site the towing service controls inside the City of Rockford, and Sec. 29-200 repeats that rule for any vehicle removed without the consent or knowledge of the owner under 625 ILCS 5/4-203. Sec. 29-201 requires an attendant on duty at the storage lot at least 8:00 a.m. to 5:00 p.m. Monday through Friday, and where no attendant is there around the clock, a posted telephone number that gets the vehicle back within two hours.
The Illinois Commerce Commission relocation towing chapter is not the operative rule here. Under 625 ILCS 5/18a-700 that chapter reaches counties of 1,000,000 or more plus counties that opt in, and Rockford sits in Winnebago County, well below that threshold, so the rate ceilings that bind a Rockford tow operator are the city figures in Sec. 29-202. State law still runs through the article in other ways. Sec. 29-203 adopts the Illinois Commercial Safety Towing Law, 625 ILCS 5/18(d)-101, by reference and makes a violation of it a city ordinance violation, and Sec. 29-202 caps the possessory lien a towing service may assert under 770 ILCS 50/1 at the rates this article allows, forbidding any increase for services or materials beyond those the article authorizes.
Violations & Fines
Sec. 00, and each consecutive day the violation continues is a separate offense. Charging a fee not authorized by Sec. 29-202, failing to give the written receipt, refusing a major credit card, storing the vehicle outside Rockford, or removing a trespassing vehicle without the written authorization of the property owner or an authorized law enforcement officer are each unlawful under that section, as is towing from private property before the required notice has been posted. A wrecker service on the police rotating list that violates Article IV faces a written warning from the police chief under Sec.
29-182, and removal from the list for an offense posing a serious threat to public safety or on a second offense within any 12 consecutive months, after written notice and an opportunity to be heard. That decision is final, and a service may be reinstated to a later year list on an adequate showing that the cause of the violation has been corrected. A towing service owner license may also be suspended or revoked by the finance director under Sec. 29-196, with an appeal to the mayor under Sec. 29-197 that must be filed within ten days and decided in writing within 30 days.
