Chapter 8-17, Property Nuisances, lists seventeen physical conditions in Section 8-17-020, and a property is deemed a nuisance and a code violation once at least three exist at the same time. The list covers damaged or missing siding on 10% or more of a structure's surface, a disintegrating roof or 10% or more damaged shingles, missing or broken garage doors, deteriorated concrete flatwork exceeding 10% of its area or a two-inch vertical displacement, dead or overgrown landscaping, a fence with missing sections or 25% peeling paint, missing window glazing, peeling paint on 25% or more of a wall, weeds over twelve inches under 8-08-040(A), unlawful rubbish accumulation under 8-08-040(B), uncovered outdoor building material storage under 8-08-040(C), an abandoned refrigerator accessible to children, a junk or inoperable vehicle under 8-20-020, an obstructed sidewalk or trail, a detached trailer left on a public street, encroachment onto public property, and off-street parking without adequate asphalt, concrete, or rock surfacing.

Once probable cause exists, Section 8-17-030 requires a written notice to the property owner stating the violations and giving twenty-one days to bring the property into compliance, extendable for reasonable cause. If the owner misses that deadline, 8-17-040 authorizes a summons and complaint, with punishment set under the Chapter 1-12 general penalty: a fine up to $2,650.00, up to 364 days in jail, or both. The city and county manager may administratively suspend enforcement in a declared natural disaster or emergency under 8-17-050.
