Daviess County's Property Maintenance Code declares dilapidated, decaying or abandoned buildings a public nuisance under Section 93.03 and lets the Solid Waste Coordinator condemn any structure found unsafe under Section 93.07, with abatement costs becoming a lien on the property.

These county ordinances apply to unincorporated areas of Daviess County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Full Breakdown

03 lists what counts as a public nuisance outside Owensboro's corporate limits, including any residence, building, outbuilding or structure in a state of dilapidation, disrepair, deterioration or decay, faulty construction, overcrowded, open, vacant, abandoned, fire-damaged to the point of being uninhabitable, in danger of collapse, or dangerous to anyone on or near the property; a structure abandoned for a minimum continuous six-month period that becomes an attractive nuisance to children or diminishes neighboring property values is separately listed. 07 lets the Solid Waste Coordinator, who also serves as Code Enforcement Officer, condemn a structure found unsafe, unfit for human occupancy, or unlawful.

An unsafe structure is one dangerous to life, health, property or safety because it lacks fire safeguards or is so damaged, decayed, dilapidated or structurally unstable that partial or complete collapse is possible; a dangerous structure or premises under subsection (F) includes blocked or unsafe means of egress, fire or vandalism damage likely to cause collapse, and buildings that have become an attractive nuisance or harbor for vagrants or criminals. 09, if the violator does not comply with a written notice, the county may remove or abate the condition itself, and the abatement cost becomes the owner's personal liability and a lien against the real property; an unpaid bill after 30 days is filed with the County Clerk as a lawful lien. 10, appointed by the County Judge/Executive with Fiscal Court approval.

Violations & Fines

Section 93.99(A) sets a fine of not less than $25 nor more than $500 upon conviction for any violation of the Property Maintenance chapter, at the court's discretion, and Section 93.99(B) makes each day a violation continues after due notice a separate offense. Abatement costs the county incurs also become a lien against the property under Section 93.09(E).

Frequently Asked Questions

What makes a property blighted under Daviess County law?
Section 93.03 defines a public nuisance to include any structure in dilapidation, disrepair, deterioration or decay, faulty construction, or overcrowded, open, vacant or abandoned condition, plus structures abandoned continuously for six months or more.
Who decides if a building is unsafe and orders it condemned?
Section 93.07 gives that authority to the Solid Waste Coordinator, who also functions as the Code Enforcement Officer, based on the unsafe-structure and dangerous-structure standards listed in that section.
What happens if I don't fix a cited property violation?
Under Section 93.09, the county may abate the condition itself after notice, and the cost becomes the owner's personal liability and a lien on the property; Section 93.99 also allows a fine of $25 to $500 with each day counted separately.
