Idaho Falls regulates blighted and deteriorated property through two main mechanisms. First, under Title 7, Chapter 2, the City adopted the International Property Maintenance Code, 2018 Edition (Section 7-2-1), as an official City code governing exterior structure and premises maintenance. Second, City Code Section 5-8-10 makes it unlawful for any person owning or controlling private property to deposit, store, or allow the accumulation of litter, which is defined to include garbage, junk, refuse, and weeds (5-8-2). Exceptions exist for temporary construction debris stored to prevent it blowing onto adjoining property, and for licensed recyclers or salvage dealers. "Junk" is defined broadly to include non-functional appliances, automobiles and parts, recreational vehicles, boats, snowmobiles, motorcycles, and farming and construction equipment. The City's Code Enforcement division handles complaints about litter and debris accumulation, non-licensed and non-functioning vehicles, tall weeds, obstructed sight lines, and lawn parking. The City publishes a per-day fine schedule for code violations of $35 for day one, $75 for day two, and $150 for each day thereafter; unpaid amounts may become a property lien or lead to a misdemeanor citation. Property owners can be required to bring premises into compliance, and the City retains the ability to abate nuisances and assess costs against the property.
