Full Breakdown
Sec. 105-254 declares it unlawful for any person, partnership, corporation, or association to own, keep, or maintain a house, building, or structure that has been found and declared a nuisance by resolution of the city council. Before that resolution passes, Sec. 105-256 requires 20 days' written notice to the owner and any lienholder, including a copy of the inspection report. Once condemned, Sec. 105-260 gives the owner 30 days from condemnation to obtain a renovation permit and start repair, rehabilitation, securing, or razing; that renovation permit expires 45 days from issue, though the council can grant one extension of up to six months conditioned on posting a bond equal to 25 percent of the original building permit value.
Sec. 105-259 separately requires broken or damaged windows and doors to be boarded within seven days of the damage, with all boarding materials removed and openings repaired within six months. If the owner does not act within 30 days after the resolution is posted on the structure, Sec. 105-261 lets the mayor or a designee repair, board, secure, raze, or remove the structure at the city's expense. Sec. 105-264 then places a lien on the property for the city's net abatement costs if the owner does not pay within 60 days of the first billing, enforceable through Chancery Court or certified to the county tax collector as delinquent taxes, plus a ten percent collection penalty.
Violations & Fines
Maintaining a nuisance-declared structure more than 30 days after the council's resolution is itself unlawful under Sec. 105-265. Sec. 105-259(f) sets a fine of no less than $100.00 for boarding/securing violations, with each day a separate offense. Unpaid abatement costs become a lien on the property under Sec. 105-264, collectible through Chancery Court or via the county tax rolls with a ten percent penalty.
