Full Breakdown

Section 7-01-100 of the Prescott Valley Town Code defines unsafe conditions in four ways. Buildings or structures that are structurally inadequate, have inadequate egress, constitute a fire hazard or are otherwise dangerous to human life are unsafe buildings. Building service equipment that is a fire, electrical or health hazard, or an unsanitary condition, is unsafe. Use of a building constituting a hazard to safety, health or public welfare by reason of inadequate maintenance, dilapidation, obsolescence, fire hazard, disaster, damage or abandonment is an unsafe use.

Parapet walls, cornices, spires, towers, tanks, statuary and other appendages in a deteriorated condition, or unable to sustain the design loads specified in the technical codes, are unsafe building appendages. Subsection E declares all of these public nuisances to be abated by repair, rehabilitation, demolition or removal under the International Property Maintenance Code as adopted and amended by Chapter 7 of the Town Code. As an alternative, the building official or another Town employee or official designated by Council can institute other appropriate action to prevent, restrain, correct or abate the violation.

The property maintenance article adds a second track: Section 9-04-010 defines a dilapidated building as any structure likely to burn or collapse whose condition endangers the life, health, safety or property of the public, and Section 9-04-020 requires owners, lessees and occupants to remove such buildings when they constitute a hazard. Section 7-01-110 creates a Board of Appeals of seven (7) voting members appointed by the Mayor and Common Council.

Violations & Fines

Section 1-08-010 makes any Code violation a class 1 misdemeanor and a civil offense carrying a civil sanction not to exceed $2,500, with each day a separate offense. Where a dilapidated building is handled under Article 9-04, the Neighborhood Services Director can give notice at least thirty (30) days before the compliance date, and the Town can abate and assess the actual cost against the property.
