Vacaville Municipal Code Chapter 8.10 (Abatement of Public Nuisance) declares a wide range of blight-producing conditions to be public nuisances, including unsecured vacant structures, exterior trash and debris, abandoned personal property, accumulated newspapers and flyers, unmaintained landscaping, and unmaintained pool barriers. The Code Enforcement Division (within the Vacaville Fire Department) administers abatement under Chapter 1.28, including administrative citations, abatement at the owner's expense, and cost recovery through liens or special assessments.
Chapter 8.10 of the Vacaville Municipal Code (Abatement of Public Nuisance) is the City's principal property-blight tool. Following amendments effective August 22, 2008, the chapter expressly requires owners, property managers, lenders, and others in charge of property to: secure the structure; maintain landscaping and the exterior of the structure; secure access gates and maintain pool barriers; keep pool water clean and clear and free of debris (or drain and keep it dry); remove exterior trash and debris; remove exterior abandoned or discarded personal property; and regularly remove newspapers, circulars, and flyers (except those required by law). Notice to Code Enforcement is required, in writing, of the person in charge of the property and their phone number when the property is vacant or anticipated to be vacant for thirty days or longer. Abatement procedure is governed by Vacaville Municipal Code Chapter 1.28 (Abatement of City Ordinance Violations), which provides for administrative citations, hearings, abatement by the City at the owner's expense, and recordation of liens or special assessments. Weeds and combustible vegetation are addressed under Chapter 8.04 (Abatement of Weeds and Rubbish); graffiti is addressed under Chapter 8.13.
A blight violation results in a Code Enforcement notice with a compliance deadline. Failure to comply allows the City to abate the nuisance at the owner's expense and to recover costs through an administrative process, including a special assessment or lien recorded against the property under Chapter 1.28. Administrative fines compound for continuing violations.
