Lakewood, CA Public Conduct: Aggressive Panhandling (2026)

Section 4239, added by Ordinance 99-2, targets the places, distances and manner of solicitation rather than the act itself. 'Solicitation' is defined narrowly as asking for the immediate payment of money or goods, whether or not anything is offered in exchange, and 'public place' reaches streets, sidewalks, parking lots, commercial areas, theaters, parks and playgrounds. Subsection D bans solicitation within 25 feet of anyone entering or leaving a vehicle, within 25 feet of anyone at an automatic teller machine, and within 6 feet of a building face fronting the right-of-way in a commercial zone.

It also bans solicitation, anywhere and at any distance, that coerces, threatens, hounds or intimidates the person being asked. The ordinance defines that coercion two ways: acting in a manner that would make a reasonable person fear for their safety, weighing threatening gestures, the solicitor's proximity, how long the encounter lasts and any physical contact, or simply continuing to solicit after the person has said, by word or conduct, that they do not want to be solicited. Subsection E carves out an exemption for solicitation inside a building open to the public, such as a store, unless the person in control of that building has posted written notice at the entrances prohibiting it.

Section 4239 sets no penalty of its own, so a violation is punished under the code's general Section 1200 default, a misdemeanor carrying up to six months in county jail and a fine capped at the state's maximum misdemeanor amount, with every day of a continuing violation counted as a separate offense. Lakewood's contract Sheriff's deputies, rather than a city police department, are the officers who cite violations of this section.
