Lehi, UT Public Conduct: Aggressive Panhandling (2026)

Lehi City Code section 6-7-4, enacted by Ordinance 21-2013 to protect residents from 'the fear and intimidation accompanying certain kinds of solicitation' while preserving constitutionally protected speech, lists specific ways soliciting money, goods or services becomes illegal. It is unlawful to solicit 'in an aggressive manner in a public area,' inside any public transit vehicle or terminal, or within thirty feet (30') of the entrance or exit of any bank, check-cashing business or ATM during its hours of operation, unless the solicitor has the owner's consent. The ordinance also bars soliciting on private property once the owner or occupant has said no or posted a no-solicitation sign, standing in a street or highway (including medians and freeway ramps) to solicit, approaching a person sitting in a parked car, and soliciting from anyone under sixteen who is unaccompanied by an adult.

'Aggressive manner' is defined in section 6-7-2 to include approaching, following or speaking to someone in a way likely to make a reasonable person fear bodily harm or property loss; intentionally touching a person or an occupied vehicle without consent; blocking or interfering with a pedestrian's or driver's safe passage, including forcing evasive action; using violent or threatening gestures; persisting after being told to stop; or using profane or abusive language likely to provoke an immediate violent reaction.

Section 6-7-5 makes any violation of the chapter a class B misdemeanor, subject to sentencing under section 1-4-1, which caps a class B misdemeanor fine at $1,000 and allows up to six months in jail.
