Lynchburg, VA Public Conduct: Aggressive Panhandling (2026)

Section 27-4, adopted to balance free passage and public safety against First Amendment solicitation rights, defines 'aggressive manner' to include approaching, speaking to or following someone in a way that would make a reasonable person fear assault or a crime; touching another person without consent; intentionally blocking someone's free passage; or intimidating someone into giving money. 'Panhandle' is defined to include approaching to beg or solicit anything of value, or trying to sell an item at double its worth or one already given away free, in circumstances a reasonable person would see as effectively a donation request.

Subsection (c) lists the prohibited acts: panhandling in an aggressive manner in any public place (1); aggressive panhandling on public transportation such as buses (2); aggressive panhandling within 15 feet of an ATM (3); panhandling while standing in a travel lane, highway, street or crosswalk directed at a vehicle occupant (4); soliciting money to clean vehicle windows while the car is in traffic (5); distributing newspapers, flyers or similar items to vehicle occupants in traffic (6); panhandling on private or residential property, including driveways and doorways, without the owner's or occupant's permission (7); and soliciting from a vehicle occupant in a travel lane while standing in the roadway or a crosswalk (8).

A conviction is a class 3 misdemeanor under subsection (d), a fine-only offense (up to $500 under Virginia's general class 3 misdemeanor penalty). Subsection (e) contains a severability clause so that if a court strikes one part, the rest of the ordinance survives. The section derives from Code 1959 § 22-6 and was substantially rewritten by Ord. No. O-06-020 (2006) and Ord. No. O-06-156 (2006) to add the aggressive-manner and ATM-proximity provisions.
