No. O-90-228, O-92-017, O-92-038), makes it unlawful to take a drink of an alcoholic beverage, hand a drink to someone else whether or not they accept it, or possess any uncapped or open container of alcohol while at or in a public park, public playground, public street, or public school ground in the city. The prohibition extends to any vehicle parked on those grounds, so a driver cannot skirt the rule by staying inside a car in a park parking lot with an open can.
A violation is a class 4 misdemeanor, the lowest misdemeanor grade Virginia law recognizes, and it applies to anyone present regardless of residency. The parks chapter treats the city stadium differently: Sec. 1(b) bans drinking anywhere in the stadium facilities except in areas the city has specifically designated for alcohol consumption, showing council can carve out licensed exceptions when it chooses to. Elsewhere in city parks and on public streets, no such carve-out exists, and the general parks rulemaking power in Sec. 28-6 lets the director of parks and recreation post additional rules for individual parks and playgrounds, violation of which is a separate class 1 misdemeanor.
