Bartow County, GA Public Conduct: Loitering Rules (2026)

Section 62-176 is part of Division 6, Management Facilities, of the county's solid waste chapter, a set of conduct rules the county commissioner adopted together in 1999 under Ordinance No. 99-5, § 803, to govern behavior at every county solid waste management facility, from staffed collection centers to the county landfill. Loitering on and about those facilities is flatly prohibited, alongside neighboring rules in the same division: alcohol and drugs are prohibited on the premises under § 62-174, scavenging through discarded material is prohibited under § 62-175, and no person has salvage rights to anything disposed of there unless the department expressly authorizes it under § 62-179.

Section 62-177 makes it the duty of every collector and other facility user to know and obey the county solid waste management department's rules, and § 62-178 requires everyone to operate safely while on site. The facilities' general hours of operation are set and posted by the department under § 62-173, and temporary hour changes or closures may be announced through the news media. Because § 62-176 does not set out its own penalty, a loitering violation falls under the article's catch-all violation clause, § 62-34, which treats any prohibited act under this article as a misdemeanor.
