Full Breakdown
The Code of the Township of East Brunswick lists Chapter 139 as Reserved. Its editor's note records that the former Chapter 139, Loitering, was adopted 8-14-67 as Ord. No. 67-85 and was repealed and rescinded on 11-13-84 by Ord. No. 84-618. Township Council action in 1984 therefore removed the general loitering chapter from the Code.
What the Code prints for public places is § 161-2, in Article II, Dangerous or Annoying Activities, adopted 5-8-51: No person shall engage in any sport, game or other activity which endangers, frightens or annoys persons in any public place. The section targets conduct that endangers, frightens or annoys; it does not use the word loitering and it prints no penalty of its own.
Loitering language survives in the park chapter. Section 158-8(I) bars any person in a park from sleeping or protractedly lounging on the seats or benches or other areas, and from loud, boisterous, threatening, abusive, insulting or indecent language or disorderly conduct tending to a breach of the public peace. Section 158-8(D) bars loitering or remaining in a pavilion or other park structure reserved and designated for the opposite sex, with an exception for children under six. Section 158-8(F) bars entering an area posted Closed to the Public.
Chapter 96 separately provides that no person shall resist, obstruct or interfere with any township officer, including any police officer, park ranger or member of a fire company or first aid squad, in the performance of his or her duty, nor disobey the lawful orders of such an officer.
In parks, the Director of Parks, Park Rangers and designated Department of Parks employees can eject violators and issue summonses before the Municipal Court under § 158-11.
Violations & Fines
In parks, Loitering is a Disorderly Persons item on the § 158-12A schedule at $50.00 for a first offense and $100.00 for a second, and each day is a separate offense. Park staff can eject violators and issue Municipal Court summonses under § 158-11. Section 161-2 prints no penalty of its own, and § 158-12 reaches violations of Chapter 158.
