Summary

Smoking is prohibited on all public land in East Brunswick Township, except in areas the Township specifically designates and equips for that purpose. Under § 158-13.1, public streets and highways as defined in Title 39, along with abutting sidewalks, are not counted as public land for this section. Public land means any land the Township owns or controls by lease, easement or other conveyance.

Smoking shall be prohibited on all public land, except in areas specifically designated by the Township and suitably equipped for that purpose. For purposes of this section only, public streets and highways as defined in Title 39 of New Jersey's Revised Statutes, including any sidewalks abutting same, shall not be considered public land.

Full Breakdown

The rule sits in Chapter 158, Parks and Public Lands, and was added on March 18, 2013 by Ord. No. 13-10. It is short and sweeping: the only place to smoke on Township public land is a spot the Township has specifically designated and suitably equipped for smoking. Section 158-2 defines public land as any land which the Township owns, or controls by lease, easement or other conveyance, so land held under a lease or easement is covered even when the Township does not hold title.

The definition of smoking in § 158-2 is broad. It covers the burning of, inhaling from, exhaling the smoke from, or the possession of a lighted cigar, cigarette, pipe or any other matter or substance that can be smoked. It also covers inhaling or exhaling smoke or vapor from an electronic smoking device, and that term includes an electronic cigarette, cigar, cigarillo or pipe. A lit cigarette held in the hand is smoking under this definition, and so is vaping.

The street carve-out is narrow. Public streets and highways as defined in Title 39 of New Jersey's Revised Statutes, including any sidewalks abutting them, are not public land for purposes of this section only. A pedestrian on such a sidewalk is outside § 158-13.1. A visitor in a Township park, on a Township field or on other Township land is inside it.

Other smoking rules in the same chapter are separate. Section 158-3(G) prohibits smoking in an indoor public place and anywhere in or on the grounds of a public or nonpublic elementary or secondary school. It also sets a 50 foot buffer at athletic and recreational events on school property where any participant is 18 or younger, and it names the courtyard at the municipal complex between the municipal building and the library, including the Veterans' Memorial and the walkways to the parking lots, as a prohibited smoking area.

Violations & Fines

Section 158-12 sends violations of Chapter 158 to the penalties in Chapter 1, Article I. Under § 1-15(A), a conviction carries one or more of a fine not to exceed $2,000, county jail not to exceed 90 days, or community service not exceeding 90 days, and each day is a separate offense. The graduated $100, $250 and up to $500 smoking fines in § 158-3(G)(5) attach to the school property, indoor public place and event rules of that subsection.

Frequently Asked Questions

Can I smoke in an East Brunswick Township park?
Only in an area the Township has specifically designated and suitably equipped for smoking. Section 158-13.1 prohibits smoking on all public land, and § 158-2 treats any area the Township owns or uses for recreation or natural resource management as a park. Park Rangers can eject a violator and issue a summons returnable in Municipal Court.
Does the ban cover vaping in East Brunswick Township?
Yes. The definition of smoking in § 158-2 includes inhaling or exhaling smoke or vapor from an electronic smoking device, and that term includes an electronic cigarette, cigar, cigarillo or pipe. The definition also covers merely possessing a lighted cigar, cigarette or pipe, so holding a lit cigarette counts.
Can I smoke on a sidewalk in East Brunswick Township?
Public streets and highways as defined in Title 39, including any sidewalks abutting them, are not treated as public land under § 158-13.1. That carve-out applies to this section only. Smoking is still prohibited inside indoor public places, on school grounds and in the municipal complex courtyard under § 158-3(G).
Who enforces the public land smoking ban?
Under § 158-11 the Director of Parks, Park Rangers, the Parks Foreman and designated Department of Parks employees enforce Chapter 158. They have authority to eject a person from the park, seize property used in a violation and issue summonses returnable before the Municipal Court.
