Section 164-7 of the Village of Hamburg Code makes the person in charge of a party or social event on private or public property liable if the party produces noise that interferes with the comfort, repose, health or safety of the public inside a building or at 25 feet or more from the source. The definition of person in charge reaches permit holders, owners and residents.

§ 164-7. Parties and other social events. ... A. It shall be unlawful for any person in charge of a party or other social event that occurs on any private or public property to allow that party or event to produce noise in a loud, annoying or offensive manner such that noise from the party interferes with the comfort, repose, health or safety of members of the public within any building or, outside of a building, at a distance of 25 feet or more from the source of such sound. B. For the purposes of this section, a "person in charge of a party or other social event": (1) That occurs on any public property shall include the person or persons who obtained permission to utilize that property for that event. (2) That occurs on any public property shall include the person who owns the premises involved and any person who lives in or on the premises involved in such part or social event. (3) Shall include the person who is listed on a permit granted pursuant to Article III of this chapter with respect to such event.

Full Breakdown

Section 164-7 of the Village of Hamburg Noise Ordinance, amended 11-3-2025 by L.L. No. 4-2025, puts the duty on the host. It is unlawful for any person in charge of a party or other social event on any private or public property to allow the party or event to produce noise in a loud, annoying or offensive manner. The test is interference with the comfort, repose, health or safety of members of the public within any building or, outside a building, at a distance of 25 feet or more from the source of the sound. The code prints no decibel threshold for parties; the 25-foot distance and the interference standard decide the case.

The definition of who is in charge is wide. Under § 164-7(B)(1) it includes the person or persons who obtained permission to use public property for the event. Paragraph (2) includes the person who owns the premises involved and any person who lives in or on the premises involved in the party or social event. Paragraph (3) includes the person listed on a permit granted under Article III of Chapter 164 for the event. A host, a tenant and a landlord can therefore each be charged for one party.

The party rule works alongside the rest of the chapter. Section 164-4 prohibits unreasonable noise and lists factors including the time of the day or night, the proximity of the noise to sleeping facilities, the volume, the duration, and the existence of complaints from people living or working in different places. Nighttime hours run from 10:00 p.m. to 7:00 a.m., and under § 164-14(F) no permit can be issued for a sound source that will operate during nighttime hours. An event with amplified sound heard outside a building in daytime hours needs a permit under § 164-14, authorized by the Village Board. The Board of Trustees of the Village of Hamburg legislates these rules; the surrounding Town of Hamburg has a separate code.

Violations & Fines

Under § 164-15 a violation is punishable by a fine not to exceed $250 or imprisonment for not more than 15 days, or both. A violation after a conviction within the preceding three years carries a fine up to $500 or up to 15 days, or both, and a violation after two or more convictions in that period carries a fine up to $750 or up to 15 days, or both.
