Las Cruces, NM Public Conduct: Loud Party Ordinance (2026)

Sec. 19-94 of the Code of Ordinances defines an "unruly gathering" as five or more persons on private property, including a business, creating unreasonably loud, disturbing or unnecessary noise, or noise detrimental to the repose, life or health of neighbors. Qualifying disturbances explicitly include noise that disturbs the peace and welfare of the community, obstruction of public streets by crowds or vehicles, drinking in public, serving or allowing alcohol to minors, fighting, disturbing the peace, and littering. The offense reaches anyone who knowingly sponsors, hosts, co-hosts, actively participates in, encourages or actively engages in the gathering; mere presence at an unruly gathering is expressly not a violation.

Police may abate an unruly gathering by any reasonable means, including citing or arresting violators or dispersing everyone engaged in the unruly conduct. The section protects a property owner, occupant, tenant or event sponsor from liability for uninvited guests' conduct, so long as they took reasonable steps to exclude uninvited people, including a landlord actively trying to evict a problem tenant; liability likewise does not attach for an invited guest's unlawful conduct that the host could not reasonably foresee or control without police intervention.

Sec. 19-95 sets graduated, escalating penalties tied to this article: a first conviction carries a fine of at least $300.00 plus 24 hours of community service; a second conviction carries at least $400.00 and 48 hours of community service; a third conviction carries up to 30 days in jail and a $500.00 fine, or both. Las Cruces Police Department officers are the enforcing agency, typically responding to a noise or nuisance call, confirming five or more people are present, and either dispersing the gathering or citing the host and identifiable participants under Sec. 19-94(c).
