Section 69-7A is the catch-all: no person can cause, suffer, allow or permit to be made verbally or mechanically any unnecessary noise. The wording reaches the person who lets the noise happen as well as the person making it, because the verbs include suffer, allow and permit, and it covers voices as well as speakers. Section 69-7B adds specific acts. Subsection (1)(b) bars operating a radio, television, phonograph or similar device in a way that creates unnecessary noise for any person other than the operator, and (1)(c) bars a sound level across a real property line, or through partitions common to two or more persons within a building, above an applicable Table 1 limit. Subsection (2) bars loudspeakers and public address systems between 10:00 p.m. and 8:00 a.m. the following day when they create unnecessary noise across a residential real property line.
Table I in § 69-6 prints 50 as the night limit at a residential receiving property. Section 69-3 defines noise as any sound of such level and duration as to be or tend to be injurious to human health or welfare or that would unreasonably interfere with the enjoyment of life or property. The Health Department administers the article, and its Noise Control Officer issues notices of violation or abatement orders. Section 69-9D adds that nothing in the article impairs any common law or statutory cause of action or legal remedy of a person for injury or damage.
Violations & Fines
Under § 69-9C a violation carries a penalty of not more than $100 for each offense. A willful or knowing violation carries not less than $100 and not more than $500 for each offense, and each day of a continuing violation is a separate and distinct offense. The Noise Control Officer can issue a notice of violation or an abatement order (§ 69-9A and B).
