Full Breakdown
Paragraph (30) of § 76-1A, titled Consumption of alcoholic beverages in public places, was added 1-5-81 by Ord. No. 2-81 to Chapter 76, Peace and Good Order. It names four settings in which no person can drink, imbibe or consume any alcoholic beverage. First, a public street, lane, roadway, avenue, sidewalk, public parking place, park, playground, recreation area or any other public or quasi-public place. Second, a public conveyance. Third, a private motor vehicle while it is in motion or parking in any public street, lane, public parking lot or public or quasi-public place. Fourth, any private property not the drinker's own, without the express permission of the owner or other person having authority to grant it. The third setting means a car parked on a public street or lot gives no exemption.
Subsection (b) defines alcoholic beverage as any fluid or solid capable of being converted into a fluid, suitable for human consumption and having an alcoholic content of more than one-half of one per centum (1/2 of 1%) by volume. The definition lists alcohol, beer, lager beer, ale, porter, several kinds of wine, distilled liquors and mixtures of the same with fruit juices.
Paragraph (10) of the same subsection separately bars being under the influence of intoxicating liquor in a public street or public or quasi-public place. Chapter 8 of the Township Code deals with licensed sales, not public drinking: § 8-1 requires compliance with the Alcoholic Beverage Law of the State of New Jersey, and the § 8-4 hours rules bind licensees on licensed premises.
The Monroe Township Police Department enforces the rule. Under § 76-5 any police member or special police officer can arrest, without a warrant, a person who violates the chapter in the officer's presence or sight and bring the person before the Municipal Judge.
Violations & Fines
Under § 76-4, a person convicted before the Municipal Judge of violating Chapter 76 faces imprisonment for a term not exceeding 90 days, a fine not exceeding $200, or both. If a fine is not paid, the judge can impose up to 90 days of imprisonment. Under § 76-3 all fines collected go into the Township treasury.
