Abilene, TX Public Conduct: Outdoor Smoking Restrictions (2026)

Abilene's smoking ordinance (Ord. No. 69-2006, effective January 3, 2007, amended by Ord. No. 41-2014) extends its indoor smoke-free rule outdoors in two specific ways. Section 10-84 flatly prohibits smoking 'at all public outdoor events, including seating areas for use by spectators,' with no distance qualifier, so a concert in the park or a game at a city stadium is smoke-free throughout. Section 10-85 layers on a buffer rule: smoking is banned within a reasonable distance of not less than twenty feet outside the entrances, operable windows, and ventilation systems of any enclosed area where smoking is already off-limits, which reaches restaurant patios and bar doorways citywide.

Section 10-86 pulls every city-owned outdoor amenity into the ordinance, naming zoos, parks, playgrounds, and golf courses specifically, though private boating on city lakes is carved out. A short list of exemptions in § 10-87 keeps the ban from reaching private residences, up to twenty percent of hotel rooms designated for smokers, and licensed retail tobacco stores. Enforcement runs through the Public Health Authority or its designee, Environmental Enforcement Officers, the Building Official, City firefighters, peace officers, Code Enforcement Officers, and the City Manager's office, per § 10-90, and any Abilene resident may file a complaint to trigger it. A violation of the smoking ban is punished under the Code's general fine schedule, § 1-9.
