AMC Β§16.65 β passed in 2007 β prohibits smoking in all enclosed indoor workplaces, including bars, restaurants, hotel lobbies, and the Sullivan Arena. The 2016 amendment added e-cigarettes and required a 20-foot buffer from doorways, operable windows, and ventilation intakes. MOA Parks and Recreation prohibits smoking on playgrounds, athletic fields, and within 20 feet of pavilions. Cannabis smoking is separately regulated and broadly prohibited in public (see public-marijuana-use). Long winter months drive heavy smoking-shelter demand outside bars; venues must ensure shelters meet the 20-foot rule and don't violate the Open Containers Code at dispensary locations.
Individual smoker: $100 first offense, up to $300 thereafter. Establishment failing to enforce: $200β$500, potential business-registration suspension after multiple violations under AMC Β§16.65.130.
