Bannock County, ID Public Conduct: Outdoor Smoking Restrictions (2026)

Section 12.20.090(A) of the Bannock County Municipal Code, part of Chapter 12.20 governing the county's recreation and events services areas, addresses smoking specifically at the Portneuf Wellness Complex: smoking, vaping and tobacco there is allowed in designated areas only, and the facility director is charged with erecting signs throughout the complex to mark those areas. The provision is narrower than the rest of Chapter 12.20's restrictions in one respect: it names only the Portneuf Wellness Complex, not the Downey Fairgrounds or the Bannock County Events Center, so the designated-area rule for smoking does not, on its own text, extend to those other recreation and events properties.

It is also narrower than an outright ban: the code channels smoking, vaping and tobacco use into marked areas rather than prohibiting it on the property entirely, unlike the flat bans the same section places on selling alcohol without authorization or, in the following paragraph, on general alcohol consumption in common areas. Violations of the chapter, including smoking outside a designated area at the complex, are treated as infractions under Section 12.20.130(B) unless separately classified as a misdemeanor. Enforcement at the Portneuf Wellness Complex runs through the Bannock County Sheriff, City of Chubbuck Police Chief, City of Pocatello Police Chief or their authorized deputies, along with the Idaho Department of Fish and Game, coordinated under an interagency memorandum of understanding per Section 12.20.030(B).
