Bannock County, ID Public Conduct: Public Urination (2026)

Section 12.20.070 of the Bannock County Municipal Code, adopted by Ordinance No. 2015-3 on August 26, 2015, sets property preservation and nuisance rules for the county's recreation and events services areas: the Downey Fairgrounds, the Events Center and the Portneuf Wellness Complex. Subsection E, headed 'Public Health,' provides that it is a misdemeanor for any person to excrete human waste, except in designated restroom facilities. Unlike most of the chapter's rules, which the county classifies as infractions carrying a maximum $300 fine under Section 12.20.130(B), this offense is expressly written as a misdemeanor, meaning it is prosecuted under a more serious classification than the chapter's own infraction cap.

The rule sits alongside other property-preservation restrictions in the same section: bans on vandalizing county property, glass beverage containers and littering, plus a requirement that greenbelt and bike-path users act safely. Enforcement is handled by the agency assigned to the specific property under Section 12.20.030: the Bannock County Sheriff at the Downey Fairgrounds, and the Sheriff, City of Chubbuck Police, City of Pocatello Police or Idaho Department of Fish and Game, working under an interagency memorandum of understanding, at the Events Center and Portneuf Wellness Complex.

An officer or authorized security personnel may eject anyone believed to be violating the chapter from the property under Section 12.20.130(A). The rule applies only within the boundaries of these county-owned recreation and events properties in unincorporated Bannock County; it does not create a general public-urination offense across the rest of the unincorporated county.
