Bayonne, NJ Public Conduct: Outdoor Smoking Restrictions (2026)

Bayonne City Code Sec 3-12.1 declares the Don Ahern Veterans Memorial Stadium a smoke-free public space, finding that tobacco smoke is a substantial health hazard to nonsmokers. The ban covers all areas enclosed by fencing, including the main field, stands, concession areas, and practice field, but does not extend to the unenclosed parking lot. It is unlawful to burn, inhale from, exhale smoke from, or possess a lighted cigar, cigarette, pipe, or any other smokable substance within the fenced confines. Smoking is also barred within 50 linear feet of any entrance or exit to the stadium.

The Health Officer or a designee, along with the Bayonne Police Department, enforce the section, and every member of the Division of Health and the Police Department is designated an enforcement officer. The City must post "No Smoking" signs at every entrance, in lettering or the international no-smoking symbol at least two inches tall, noting that violators face a fine. Penalties escalate with each offense: up to $100 for a first violation, $100 to $200 for a second, and $200 to $500 for a third or subsequent violation, all classified as an infraction.
