Bayonne, NJ Public Conduct: Public Alcohol Use (2026)

Section 3-5.2.a lists where an open container or public drinking is banned: "In or on a public street, sidewalk, public parking place, park, playground, recreation area, school buildings, or grounds, or any other public or quasi-public place or in any public conveyance," in a private or commercial vehicle whether moving or parked in public, and on private property belonging to someone else without that owner's permission. Paragraph b separately bans discarding an alcoholic beverage container in any of those same public places or on another's private property.

Paragraph c gives the Mayor and Council a narrow carve-out: they may, by resolution, permit alcohol at a designated park during a specific authorized event. A related but separate rule, § 3-5.1, bars consuming alcohol inside an unlicensed restaurant or dining room that has no on-premises liquor license, closing the loophole of "BYOB" drinking at a food establishment that never obtained one. Penalties for either section run through § 3-5.3 to the Chapter 1, § 1-5 general schedule: up to a $1,250 fine, up to 90 days in the county jail, or up to 90 days of community service.
