Bayonne, NJ Public Conduct: Public Urination (2026)

Section 3-6.1, the whole of the "Public Nuisance" article in the police regulations chapter, reads in full: "No person shall urinate or defecate or commit any kindred nuisances in any public street, sidewalk, public or quasi-public place not provided for such purpose." The section carries forward 1972 Code § 6-23.1 without amendment and sets no separate penalty of its own, so a violation falls under the Chapter 1, § 1-5 general penalty like most Chapter 3 offenses: up to a $1,250 fine, up to 90 days in the county jail or in a municipal detention facility, or up to 90 days of community service, at the Municipal Court judge's discretion, with a $100 minimum fine where the Council has set one.

Because the offense sits inside the police regulations chapter rather than the health code, Bayonne Police officers are the front-line enforcers, and, as with the rest of Chapter 3, a continuing or repeated violation on the same day can still be charged as a distinct offense under the same general provisions that apply to disorderly conduct and loitering nearby in the same chapter.
