It does not ban smoking on every outdoor patio in the city. It reaches two places: any city park and the premises of any city park recreational facility.
The code defines smoking as inhaling, exhaling, burning, carrying, or possessing any lighted tobacco product, including cigarettes and pipe tobacco. Vaping means inhaling or exhaling vapor from a vapor-generating electronic device, or possessing one while it is actively producing vapor or aerosol from a nicotine product or any other substance. Merely carrying a device that is switched off is not vaping. Unfiltered cigars are expressly not regulated by this section.
Enforcement runs through trespass warnings. Any on-duty city employee who personally sees someone smoking or vaping on city-owned or leased park property can give a verbal warning to stop. A second warning, from the same or a different employee, means the person must stop and must not remain on the property. A person who stays on city property after the warning, even after putting the cigarette or vape out, faces arrest for trespass under F.S. § 810.09.
The warning also works as a trespass notice. After a first warning the person must leave at once and stay away for at least six months, rounded to a full day's use of the property. If the person violates the section again after that six-month period, the exclusion becomes at least one year. The city keeps a list of the people warned, where each warning happened, and the period each person is trespassed.
Subsection (d) keeps other code enforcement tools available. Separately, Sec. 14-3-1 and Sec. 14-3-2 make electronic smoking a public nuisance and prohibit it in city buildings, city-owned or controlled outdoor seating areas, and public transit stations or stops, plus anywhere the Florida Clean Indoor Air Act already bars smoking.
