Coeur d'Alene, ID Public Conduct: Outdoor Smoking Restrictions (2026)

Chapter 4.35, the Smoke-Free Zone chapter, bans smoking in all outdoor areas of the City Hall Campus. The chapter defines the campus as the area around City Hall and the City library, specifically the parking areas, driveways, and sidewalks adjacent to those two buildings, plus the part of McEuen Park that lies west of City Hall and the library and east of the Pavilion. The upper City Hall parking lot south of the City Hall building is carved out, along with a portion of the sidewalk adjacent to the splash pad, playground, and tennis courts, as marked on a map printed in the code.

The definition of smoking is wide. It means inhaling, exhaling, burning, or carrying any lighted or heated cigar, cigarette, pipe, or device or any other lighted or heated tobacco or plant product, or chemical compound, intended for inhalation, and it includes the use of an electronic smoking device which creates an aerosol or vapor. Vaping is therefore covered.

Three housekeeping rules back up the ban. No ash can, ashtray, or other smoking waste receptacle can be placed in any area where smoking is prohibited. No person can dispose of used smoking or tobacco product waste within the boundaries of the City Hall Campus. And a misplaced receptacle or a missing no-smoking sign is not a defense to a violation. The City Council's stated intent in § 4.35.010 is to protect the public health and the rights of nonsmokers by prohibiting smoking in a specified area around City Hall and the City Library, which is frequented by adults and children.

Other smoking rules sit elsewhere in the code. Section 4.25.060 prohibits smoking and all activities capable of generating an open flame in all City owned, leased or maintained natural areas. Section 4.15.040 C.10 prohibits smoking of cigarettes, cigars, pipes, or other lighted or heated devices intended for inhalation in any enclosed area of any parking facility. Chapter 4.35 itself is limited to the City Hall Campus.
