Corvallis, OR Public Conduct: Outdoor Smoking Restrictions (2026)

Section 5.03.080.160.02 prohibits smoking in every public place within the City or on City property, a list that includes elevators, restrooms, lobbies, public transit, service lines and within 10 feet of them, retail stores and other businesses open to the public, restaurants, theaters, sports arenas and bowling alleys, public meeting rooms, health care facility common areas, apartment and mobile home park common areas, and polling places. Subsection 2 extends the ban to all City-owned parks, trails, and open space, excluding only designated parking areas, and subsection 3 sets a 50-foot buffer around the Corvallis-Benton County Public Library building, covering its grounds, patios, plazas, steps, ramps, and parking structure, with a private-vehicle exception for closed cars.

Subsection 4 covers the entire City Hall block, and subsection 6 bars smoking within 10 feet of any congregate living facility. Section 5.03.080.160.04 sets a citywide floor: smoking is barred within a reasonable distance, never less than 10 feet, of any entrance, exit, opening window, ventilation intake, or accessibility ramp of a place where smoking is already prohibited, and Section 5.03.080.160.065 applies the same 10-foot buffer to ashtrays. Section 5.03.080.160.05 exempts private residences (unless used as licensed child, adult day, or health care facilities), up to 25 percent of hotel or motel rooms designated smoking under ORS 433.850(2)(a), and long-term rented rooms of over a month. Section 5.03.080.160.10 sets the penalties.
