Hackensack, NJ Public Conduct: Outdoor Smoking Restrictions (2026)

Section 117-8, added by Ord. No. 6-2014, defines smoking to include burning, inhaling or possessing a lit cigar, cigarette, pipe or other tobacco product, plus inhaling or exhaling vapor from an electronic smoking device. Subsection B bans smoking in all municipal buildings, defined as any structure owned, leased, rented or operated by the City and used for official City business, with no-smoking signage required at every entrance and interior smoking area. It separately bans smoking within a 35-foot radius of the front entrance of every municipal building, again with required posted signage at the building and the perimeter. It bans smoking in public parks and recreation facilities owned or leased by the City, including adjacent parking areas, driveways and drive aisles, wherever those areas have been designated with no-smoking signs, and it bans smoking in any vehicle registered to the City. Enforcement authority is shared among the Police Department, Fire Department, Recreation Department, Public Works Department and Health Department.
