Frequently Asked Questions

Can I smoke in a Hawthorne city park?
No. Section 8.48.030(A)(1) bars smoking in any city park or recreational facility, along with every other city building, structure, parking lot or vehicle, with no exception for outdoor park areas.
How close to a smoke-free area can I smoke in Hawthorne?
Not within 20 feet, per § 8.48.040. That buffer applies around schools, around any area already off-limits under § 8.48.030, and around entrances, windows or air intake vents to smoke-free enclosed spaces, unless you are simply passing through.
What happens if I violate Hawthorne's smoking ban?
The city attorney can charge it as a misdemeanor, an infraction, or pursue a civil action carrying a fine of $100 to $1,000 per violation under § 8.48.060, and the violation is separately treated as a public nuisance.
Does the ban cover apartment building common areas?
Yes. Section 8.48.030(A)(3) prohibits smoking in enclosed common areas of multi-unit residential complexes, and leases dated on or after February 1, 2022 must contain a clause spelling that out.
